1. Introduction

GetBooks, operated by Three Things Media, respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512) ("DMCA"), we will respond promptly to claims of copyright infringement committed using the GetBooks service (getbooks.app).

If you believe that content available on or through GetBooks infringes your copyright, please submit a notification as described below. Upon receipt of a valid DMCA notice, we will take appropriate action, which may include removing or disabling access to the allegedly infringing material.

2. Reporting Copyright Infringement

To file a DMCA takedown notice, please provide a written notification that includes the following information:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. A description of the copyrighted work claimed to have been infringed. If multiple copyrighted works are covered by a single notification, you may provide a representative list.
  3. A description of the material that you claim is infringing, including the specific URL(s) or other information sufficient to allow us to locate the material on GetBooks.
  4. Your contact information, including your name, mailing address, telephone number, and email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notification is accurate, and that you are the copyright owner or are authorized to act on behalf of the copyright owner.

4. Counter-Notification

If you believe that material you posted on GetBooks was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification. Your counter-notification must include the following:

  1. Your physical or electronic signature.
  2. A description of the material that was removed or to which access was disabled, and the location at which the material appeared before it was removed or disabled.
  3. A statement, made under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the courts in Ingolstadt, Germany, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Counter-notifications should be sent to our designated agent at the address listed above.

5. Actions Upon Receipt

Upon receiving a valid DMCA takedown notice, we will take the following steps:

  1. Remove or disable access to the allegedly infringing material.
  2. Notify the user who posted the material that it has been removed or disabled.
  3. Provide the user with a copy of the takedown notice and information about filing a counter-notification.

If we receive a valid counter-notification, we will forward it to the original complaining party. If the complaining party does not notify us within 10 to 14 business days that they have filed a court action to restrain the allegedly infringing activity, we may restore the removed material.

6. Repeat Infringers

In accordance with the DMCA, we have adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat copyright infringers. We may also, at our sole discretion, limit access to the Service or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

7. Good Faith and Misrepresentation

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees.

Please do not make false claims. Before filing a DMCA notice, consider whether the use of the copyrighted material at issue may be protected by the fair use doctrine, as you could be held liable for damages if you knowingly file a false claim.
